Advice for Safer Yoga

You are encouraged to have body awareness and self-responsibility in my online yoga as follows:  

  • It’s your body and only you can know how you feel in the poses. Pay attention to, respect and listen to your body.
  • You should not feel pain at any point in the class. If you feel anything other than mild discomfort from stretching and extending, gently come out of the pose.
  • Hold a pose only as long as you feel comfortable and feel free to take a break or modify if you feel you have held a position long enough for you.
  • Do not force your body into positions, rather use your breath to allow you to extend and hold a stretch.
  • Extension and progression will happen over time. Be patient and allow your body to progress at a healthy pace, thereby minimising risk of injury due to forced intensive stretching.

I HAVE READ THE BELOW TERMS AND CONDITIONS AND FULLY UNDERSTAND THEM.

UPON SUBSCRIBING TO AND TAKING PART IN THINK HEALTHY BE HEALTHY’S ONLINE KEEP CALM AND DO YOGA CLASSES, I FULLY AGREE and ACCEPT THE TERMS AND CONDITIONS BELOW UNDER MY OWN FREE WILL:

  1. Provision of Services
  • All references to I in this document refer to Clare Wright of Think Healthy Be Healthy as service provider. For the purposes of this agreement, Clare Wright and Think Healthy Be Healthy are used interchangeably. All references to you in this document refer to yourself, as client and purchaser of my services.
  • All business carried out for you by Clare Wright / Think Healthy Be Healthy are based on these Terms and Conditions of Business.
  1. Risks and Disclaimers
  • In participating in online yoga offered by Clare Wright and/or Think Healthy Be Healthy, I recognize that exercise requires physical exertion which may be strenuous and may cause physical injury and I am fully aware of the risks and hazards involved.
  • I understand that, as is the case with any physical activity, the risk of physical injury, which could be serious, is always present and cannot be entirely eliminated. I accept that it is my responsibility to choose to do or not to do particular poses and if I experience any pain or discomfort, I will listen to my body and make adjustments accordingly or discontinue the activity.
  • I acknowledge that I take ultimate responsibility for deciding whether I do the online yoga and accept that I voluntarily take part at my own risk. I assume all responsibility for my participation and for any and all risks, injuries or damages which I may incur through this. I voluntarily and expressly waive any right to bring any action or claim against Clare Wright and/or Think Healthy Be Healthy.
  • I recognise that it is my responsibility to consult a doctor/physician prior to and regarding my participation I understand that yoga is not a substitute for medical attention, examination, diagnosis or treatment and there are certain medical conditions where yoga is not advised. If I am not in good health or physical, mental or emotional condition and have any concerns about the suitability of yoga, I will seek the advice of my doctor/physician.
  • In signing up to Think Health Be Healthy’s Keep Calm and Do Yoga online membership, I am doing so on the basis that I am in good health and physical, mental and emotional condition to participate in such a class. At the same time, there are many wider benefits of yoga, physically, mentally and emotionally, and yoga can be adapted for injuries and therefore if I have any queries on its suitability for me, I will check with a suitably qualified professional such as doctor/physician or physiotherapist before commencing any classes.
  • If I am pregnant, post-natal or post-surgical, I confirm that I will obtain my doctor’s approval to participate. In understand that if I am pregnant, postnatal or post-surgical, I participate fully at my own risk, and in the case of pregnancy, at that of my unborn child/children.
  1. Qualifications and Professional Registration

3.1 I, Clare Wright, am a qualified yoga teacher holding a YTT 200 qualification.

3.2 I also hold an Advanced Diploma in Coaching, Master Practitioner in NLP and Diploma in Ericksonian Hypnotherapy and am a member of the British Institute of Hypnotherapy and NLP (BIH).

3.3 Certificates for the above qualifications and membership are available can be seen upon request.

  • All information you provide is treated in the strictest confidence
  • Information or details held by Clare Wright and/or Think Healthy Be Healthy are held in compliance with the provisions of the Data Protection Act 1998 and 2018 GDPR.
  1. Fees and Payment

5.1 You agree to pay the monthly subscription fee incurred by you to use my online yoga service. Your monthly fee will be taken upon signup and every 30 days thereafter unless you choose to cancel.  See section 6.1 below for cancellation details.

5.2  I may revise the pricing for my online yoga membership with one month’s notice. Such changes shall be effective one month from me mailing my online yoga members. Those choosing not to subscribe to my emails should note that this is my main method of member communication and due to GDPR, in not signing up, I am unable to keep you informed of any changes.

5.3  Fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable. Unless otherwise noted, all currency references are in UK Pounds Sterling.

5.4 If there is a dispute regarding payment of fees  for the online yoga membership provided by Clare Wright and/or Think Healthy Be Healthy, your membership may be terminated and your access withdrawn without warning or notice at Think Healthy Be Healthy’s sole discretion.

5.5  You acknowledge and agree that any subscription fees are refundable in whole or in part at the sole discretion of Clare Wright and / or Think Healthy Be Healthy.

5.6 Think Healthy Be Healthy may, from time to time, modify, amend, or supplement any fee-billing methods and such changes may take effect immediately on emailing my online yoga subscribers.

  1. Cancellation and Termination

6.1 You have the right to cancel your subscription at any time. To cancel, email via the contact form requesting cancellation of your membership. Future monthly membership payment will be stopped within 24 hours of my receipt of your email and you will receive an email confirming this. Your  subscription continue will run until the end of your  current monthly payment period and no further payments will be taken after this. Refunds will not be given for any time remaining on your current payment period from cancellation of membership.

  • Think Healthy Be Healthy reserves the right to modify, suspend, and terminate your subscription and/or to refuse to provide my services to you or allow access to my services, at my sole discretion, without prior notice, at any time and for any or no reason and without any liability to you, including but not limited to any of the following reasons: (a) breach or violation of these Terms; (b) upon request by law enforcement; (c) due to unforeseeable technical or security issues or problems; (d) for fraudulent, deceptive or illegal activity, or other activity which I believe is harmful or not in keeping with the ethos of my services, online membership and/or business interests.
  • Upon termination of your access to or ability to use my services, including but not limited to suspension of your membership, your right to use or access any service and/or any content will immediately cease.
  • You agree that termination, limitation of access and/or suspension shall be made at my sole discretion and that Clare Wright and /or Think Healthy Be Healthy shall not be liable to you or any third party for the termination, limitation of access, and/or suspension of your membership.
  1. Apps, Other Websites and Third Party Services

7.1 When you use my online services, you may also be using the services of one or more third parties, such as a wireless carrier, mobile platform provider, online video services and others. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.

7.2 Where my site contains links to websites of third parties, if you use these links, you will leave my website. These third parties and their websites are not under my control. I do not examine or evaluate these websites and I am not responsible for their content or operation. By providing links to these websites, I do not approve, warrant or endorse, or otherwise make any representation about them or their owners or operators, and do not assume any related responsibility or liability. You should exercise your own judgment in evaluating and using these websites. When you link to these websites, you become subject to their terms and conditions of use and privacy policies and should review them carefully before entering any such websites. I do not endorse these websites and my Terms and Conditions of Business and Privacy Policy do not apply to them.

7.3 You expressly release Clare Wright and/or Think Healthy Be Healthy from any and all liability arising from your use of any third party website, service or content. You specifically agree that I am not responsible for any loss or damage of any sort resulting or arising from your dealings with those third party websites and/or their advertisers.

  1. Copyright of Material

8.1 All videos, content and material of my Keep Calm and Do Yoga programme and Think Healthy Be Healthy Website are the intellectual property of and owned by Clare Wright / Think Healthy Be Healthy and must not be copied or shared or used.

  1. Access Details

9.1 Any links, passwords or access details are provided for your sole use only and must not be shared.

9.2 Details of any links, passwords and access details should be kept securely and with care to avoid unauthorised use.

  1. Miscellaneous.

10.1 I reserve the right to modify these Terms and Conditions of Business and/or any other guidelines or policies affecting my services or website at any time, and may do so from time to time. Such revisions will become effective upon distribution of the revisions by email to those who have chosen to sign up to my online yoga member’s mailing list. As my online yoga members mailing list is my principal means of keeping members informed, you understand and accept that should you choose not to sign up to this mailing list,  you accept you that you will not be informed of changes to my Terms and Conditions of Business. If you are not already on my online yoga members’ mailing list and would like to be added to be kept informed, you can request to be added by emailing me via the contact form.

10.2 I  may, either partially or in its entirety and without being obligated to provide prior notice, modify, adapt or change the website and/or any of its services, features, the user interface and design, the extent and availability of the content in or on the website and any other aspect related to the website. You will have no claim, complaint or demand against Clare Wright and/or Think Healthy Be Healthy for applying such changes or for failures incidental to such changes.

10.3 Should you have any problems or queries at any time during your subscription to this online yoga membership from Clare Wright / Think Healthy Be Healthy, please raise them with myself, Clare Wright, by emailing via the contact form.

  1. Law

11.1 These Terms and Conditions of Business shall be governed by and construed in accordance with the laws of Scotland.

11.2 Any dispute arising out of or in connection with the Agreement will be subject to the exclusive jurisdiction of the Scottish Courts.
